Agreement to Terms

By installing or using GitRhythm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use the Service.

Short version: Use the service responsibly. GitRhythm is currently free while in beta. We may introduce paid plans in the future, but we'll give you advance notice before any charges apply.

Description of Service

GitRhythm is a GitHub Marketplace application that provides pull request analytics and velocity tracking.

The Service includes:

  • Automated collection of pull request metadata from your GitHub repositories
  • Business-hours aware metrics and analytics
  • Interactive dashboards and data visualizations
  • Data export capabilities (CSV)
  • Configuration options for business hours, holidays, and branding

Account Requirements

  • You must have a GitHub account to use the Service
  • You must provide accurate information during registration
  • You are responsible for maintaining the security of your GitHub account
  • One installation per account or organization

Acceptable Use

You May

  • Use the Service for analyzing your own GitHub repositories
  • Install the Service to organizations you have permission to manage
  • Export and use your analytics data as you see fit
  • Cancel or uninstall at any time

You May Not

  • Attempt to reverse engineer, decompile, or hack the Service
  • Use the Service to violate any laws or regulations
  • Abuse, harass, or threaten our staff or other users
  • Attempt to abuse or exploit the Service
  • Overload our systems with excessive API requests
  • Share your account access with unauthorized users
  • Use the Service for any illegal or unauthorized purpose

Pricing

Current Offering

GitRhythm is currently offered at no cost while in beta. You will not be charged for using the Service during this period.

Future Pricing

We may introduce paid subscription plans in the future.

If we do:

  • We will provide advance notice via email before any charges apply
  • You will have the option to upgrade to a paid plan or discontinue using the Service
  • No charges will be applied without your explicit consent
  • All billing will be handled through GitHub Marketplace

Cancellation & Termination

You Can Cancel

  • Uninstall the app anytime through your GitHub Marketplace settings
  • Access ends immediately when you uninstall
  • Your data is retained for 30 days after uninstall, then permanently deleted
  • You can request immediate data deletion by emailing support@gitrhythm.com

We Can Terminate

We reserve the right to suspend or terminate your access if you:

  • Violate these Terms of Service
  • Use the Service in a way that harms others or our infrastructure
  • Provide false or misleading information
  • Engage in abusive or illegal activity

We'll provide notice before termination except in cases of serious violations.

Service Availability

Uptime

  • We strive for continuous uptime but do not guarantee it
  • Scheduled maintenance will be announced in advance when possible
  • We are not liable for downtime caused by third-party services (GitHub, hosting providers, etc.)

Service Modifications

  • We may add, modify, or remove features at any time
  • We'll notify you of significant changes that affect core functionality
  • We will not remove features that are central to the service without notice

Data Accuracy

  • We sync data from GitHub's API and display it as accurately as possible
  • We are not responsible for inaccuracies in GitHub's data
  • Business hours calculations are based on your configuration settings

Data & Privacy

  • Your use of the Service is governed by our Privacy Policy
  • We only access pull request metadata, not your source code
  • You retain all rights to your data
  • You can export your data at any time via CSV
  • We delete your data within 30 days of account cancellation

Intellectual Property

Our Rights

  • GitRhythm, our logo, and the Service are our intellectual property
  • You may not copy, modify, or distribute our code or branding
  • All rights not expressly granted to you are reserved by us

Your Rights

  • You retain all rights to your GitHub repositories and data
  • You own the analytics data we generate from your repositories
  • You may use, share, or publish your analytics data freely

Warranties & Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

  • We do not guarantee the Service will be error-free or uninterrupted
  • We do not warrant that the Service will meet your specific requirements
  • We are not responsible for decisions you make based on our analytics
  • Use of the Service is at your own risk

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from service interruptions or data inaccuracies
  • Any damages arising from your use of the free Service

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

GitHub Marketplace Terms

As a GitHub Marketplace application, your use of GitRhythm is also subject to:

In case of conflict between these Terms and GitHub's Terms, GitHub's Terms prevail.

Dispute Resolution

  • Informal Resolution: Contact us first at support@gitrhythm.com to resolve disputes informally

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Updating the "Last Updated" date at the top
  • Sending an email to your registered email address (for significant changes)
  • Posting a notice on our website

Continued use of the Service after changes constitutes acceptance of the updated Terms. If you don't agree to the new Terms, you must stop using the Service and uninstall the app.

Miscellaneous

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us
  • Severability: If any provision is found unenforceable, the rest remains in effect
  • No Waiver: Our failure to enforce any right doesn't waive that right
  • Assignment: You may not assign these Terms; we may assign them to an acquirer
